An Act to enable the Mayor, Aldermen, and Bur-
gesses of the Borough of Newport in the Isle of
Wight to raise Monies for the Improvement of
the Navigation of the River Medina, within the
Borough, and to alter and amend certain ancient
Tolls and Duties payable to the said Mayor,
Aldermen, and Burgesses. [28th May 1852]

HEREAS Newport in the Isle of Wight is the principal
Market Town of the Island, and is situate on the River
Medina, but such River is navigable only at .certain
Times of the Tide, and for Vessels of smaller Burden than the Trade of
the Borough and of the surrounding District requires, and than would
be employed if the Navigation of the said River was improved, and
at Low Water the said River is altogether useless as a Means of Com-
munication between Newport and the Sea, by reason whereof great In-
convenience is experienced by the Owners and Masters of Vessels resort-
ing thereto, and the Trade of the Inhabitants and of the surrounding
District is greatly interfered with: And whereas it would tend much
to the Prosperity and Advancement of the said Town, and to increase
the Trade of the said Borough and surrounding District, and would
be of great Benefit and Convenience to the Public resorting to and
to the Inhabitants of the said Island, if the Channel of the said
River, within the Limits herein-after mentioned, were improved so as

to be navigable at all Times of Tide, and if within such Limits
Quays, Wharfs, and other necessary and suitable Works and Conveni-
ences for the Trade were constructed: And whereas the Mayor,
Aldermen, and Burgesses of the Borough of Newport, and the Inha-
bitants of the said Borough and surrounding District, and the Masters
and Owners of Vessels trading to the said River, are desirous that the
Navigation of the said River within the Limits aforesaid should b6
improved, and that the Quays and Wharfs of the said River should be
made accessible for Vessels of greater Burden, and that other Quays,
Wharfs, and Conveniences for the Trade should be constructed, and
that adequate Funds should be provided for such Purposes: And
whereas the Queen's most Excellent Majesty, in right of Her Crown,
and by virtue of the Royal Prerogative, has Jurisdiction over all navi-
gable Rivers within the United Kingdom, and is seised of the Ground
or Soil and Beds and Shores of such Rivers as far as the Tide flows
and reflows therein, subject only to such Grants and Conveyances of
the Rights and Estate of the Crown in any of such Rivers as have
been or may by Law be presumed to have been heretofore made by
Her Majesty or any of Her Predecessors, and as are still subsisting
and now in force: And whereas by virtue of divers ancient Charters
heretofore granted to the Bailiffs and Burgesses of the said Borough,
the said Mayor, Aldermen, and Burgesses are entitled to receive and
take,
and have received and taken, certain Tolls and Duties called
Petty Customs upon all Goods, Wares, and Merchandise imported into
or exported from any Part of the said Borough, and also certain Tolls
and Duties upon all Goods, Wares, and Merchandise unloaded from or
loaded on to Vessels at the Wharf belonging to the said Mayor,
Aldermen, and Burgesses, called the Town Quay: And whereas such
Tolls and Duties are of various and different Amounts, and ill adapted
to the Trade of the said Borough and Island, and it would be greatly
to the Convenience of the Persons engaged in the Trade and Com-
merce of the said Borough and Island, and tend to prevent Disputes
and Litigation, if, instead of such ancient Tolls and Duties, the said
Mayor, Aldermen, and Burgesses were authorized to receive and take
the several Tolls and Duties set forth in the Fourth Schedule to this

Act: And whereas, for the Purpose of improving the Navigation of
the said River within the Limits aforesaid, and of constructing and
maintaining within such Limits suitable Quays, Wharfs, and other
Conveniences for the Trade of the said River, it is expedient that the
said Mayor, Aldermen, and Burgesses should be empowered to levy
the several Rates, Tolls, and Duties set forth in the Third Schedule
to this Act, in respect of Vessels frequenting the said River, and of
the Passengers, Horses, Cattle, Sheep, and Coals conveyed in such
Vessels between a certain Place in the said Borough called the Folly
and the said Town Quay; but the same cannot be effected without the
Authority of Parliament: May it therefore please Your Majesty that
it may be enacted; and be it enacted by the Queen's most Excellent
Majesty, by and with the Advice and Consent of the Lords Spiritual
