The River Tummel Catchment Area Protection (Renewal) Order 1991

Coming into force 8th October 1991

The Secretary of State, having received no complaints concerning the implementation of proposals, in exercise of the powers conferred on him by section 1(7) of the Freshwater and Salmon Fisheries (Scotland) Act 19761and of all other powers enabling him in that behalf, hereby makes the following Order:

S-1 Citation and commencement

1. This Order may be cited as the River Tummel Catchment Area Protection (Renewal) Order 1991 and shall come into force on 8th October 1991.

S-2 Interpretation

Interpretation

2. In this Order—

“the 1983 Order” means the River Tummel Catchment Area Protection Order 19832;

“the 1988 Order” means the River Tummel Catchment Area Protection (Renewal) Order 19883;

S-3 Renewal of Order

3. The 1988 Order is hereby renewed.

S-4 Prohibition

Prohibition

4. During the period from 8th October 1991 to 7th October 1994, both dates inclusive, fishing for or taking freshwater fish in the inland waters in the area prescribed in article 4 of the 1983 Order, without legal right or without written permission from a person having such a right, is hereby prohibited.

This Order renews for the third time the prohibition contained in Article 3 of the River Tummel Catchment Area Protection Order 1983 which prohibited fishing for or taking freshwater fish in inland waters in the area prescribed in that Order without legal right or without written permission from someone having such a right. The effect of the renewal is that the prohibition has effect from 8th October 1991 to 7th October 1994.

The prescribed area referred to is the whole of the catchment area of the River Tummel upstream from its confluence with the River Tay at Ballinluig which area lies within the Tayside, Highland and Strathclyde Regions, but excluding that part of the catchment area of Loch Ericht lying within Highland Region. The area is illustrated on a map attached to the 1983 Order and is defined by reference to a detailed large scale map which may be inspected at the principal office of the Scottish Office Agriculture and Fisheries Department in Edinburgh, on any working day between 10am...
