case 522. eoe v. williamson. Hil. 25 & 26, Rot. 719. S. C. 2 Lev. 140. 3 Keb. 490. The demise laid in the declaration in ejectment must not exceed the term which the lessor of the plaintiff in fact possesses (a). A lessee for three years demises to B. for five years, who brings an ejectment, and declares agaiust the first lessor for five years ; and upon the evidence it appeared, that he had right but for three years, because A. that leased to him had no more; and the Court were of opinion, that the plaintiff could have no judgment.
