The Rural District Council Election Rules, 1959

In pursuance of the powers conferred upon me by section twenty-nine of the Representation of the People Act, 1949(a), and by sub-paragraph (1) of paragraph 31 of the Eighth Schedule to the Local Government Act, 1958(b), I hereby make the following Rules:—

1.—(1) Paragraphs (1) and (3) of Rule 2 of the Rural District Council Election Rules, 1951(c) (which relates to polls of rural district and parish councillors being taken together), are hereby revoked.

(2) In paragraph (2) of the said Rule 2 for the words "Where polls are so taken together" there shall be substituted the words "Where the poll at an election of rural district councillors is taken together with the poll at an election of parish councillors".

2. For the proviso to paragraph (1) of rule 3 in the First Schedule to the Rural District Council Election Rules, 1951 (which relates to the hours of poll), there shall be substituted the following proviso:—

"Provided that the poll shall be kept open till nine o'clock in the evening—

(i) where the poll is taken together with the poll at an election of parish councillors, if the poll at the last-mentioned election is kept open till nine o'clock in the evening; or

(a) 12, 13 & 14 Geo. 6. c. 68.

(b) 6 & 7 Eliz. 2. c. 55.

(c) S.I. 1951/266 (1951 II, p. 361).

(ii) whether or not the poll is so taken, if candidates remaining validly nominated at the election of rural district councillors to a number not less than the number of vacancies at that election have by written notices signed by them and delivered at the place and within the time for delivery of notices of withdrawals of candidature at that election so requested.".

3. These Rules may be cited as the Rural District Council Election Rules, 1959, and shall come into operation on the twenty-third day of March, 1959.
