Her Majesty, in exercise of the powers conferred upon Her by section 27(1) and (2) of the Scottish Public Services Ombudsman Act 20021, and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered as follows:

1. This Order may be cited as the Scottish Public Services Ombudsman Act 2002 (Commencement and Revocation of Transitory and Transitional Provisions) Order 2002.

S-2 Commencement of Provisions

Commencement of Provisions

2. The Scottish Public Services Ombudsman Act 2002 in so far as not already in force shall come into force on 23rd October 2002.

S-3 Revocation of the Scotland Act 1998 (Transitory and Transitional Provisions) (Complaints of Maladministration) Order 1999

3. The appointed day for the purpose of article 3 of the Scotland Act 1998 (Transitory and Transitional Provisions) (Complaints of Maladministration) Order 19992shall be 23rd October 2002.

(This note is not part of the Order)

This Order brings into force on 23rd October 2002 the sections of the Scottish Public Services Ombudsman Act 2002 (“the Act”) not brought into force on Royal Assent. The Act received Royal Assent on 23rd April 2002. Sections 1, 23, 24, 26(2) and 27 and Schedule 1 came into force on Royal Assent.

The Order also revokes the Scotland Act 1998 (Transitory and Transitional Provisions) (Complaints of Maladministration) Order 1999. Article 3 of that Order provides that, unless previously revoked by the Secretary of State, it shall cease to have effect on the day appointed by or under an Act of the Scottish Parliament.
