IN THE COURTS OF EXCHEQUER AND EXCHEQUER CHAMBER
sikdefeeld v. price. Exch. Ch. in Eq. Gray's Inn Hall, Sittings after Term. Dec. 17th, 1827.-On a bill by a creditor against an executor, for payment of his demand, arid an account of the testator's estate, the Court, in consequence of some doubt respecting the validity of the debt, retained the bill for a year, with liberty for the plaititift' to bring an action. And the statute of limitations having taken effect between the filing of the bill and the decree, the Court restrained the defendant from insisting at law on the benefit of that statute. This suit was instituted by a person claiming to be a creditor in respect of two several promissory notes, and a memorandum, or I. O. U., against executors, for payment of his debt and the usual accounts of the debtor's estate.
