The appellant boy, a citizen of Jamaica born on 30.5.57, applied for an entry certificate in February 1971 to enable him to join his natural mother in the United Kingdom. He had lived with his maternal grandmother since he was a year old, and his mother since she came to this country in 1962 had made regular remittances to his grandmother for his support. His application was refused by the respondent, and the refusal was upheld by an adjudicator to whom he appealed. On his further appeal to the Tribunal a large number of letters dating back to March 1970 was tendered in evidence. They corroborated the mother's evidence before the adjudicator that she had continuously been consulted by the appellant's guardian regarding his schooling, upbringing and activities, and they showed that she had never abdicated responsibility for her son.

Held: (allowing the appeal) (i) decisions in cases in which the issue of sole responsibility, referred to in para 39 of Cmnd 4298, fell to be determined involved consideration, inter alia, of the source and degree of financial support for the child and whether there was cogent evidence of genuine interest and affection for the child by the sponsoring parent in the United Kingdom;1

(ii) in the present case the sponsor had been the appellant's sole financial support since 1962, and she had demonstrated a continuing and positive concern in the welfare and upbringing of the appellant.

Determination

The appellant Rolleto Emanuel Sloley, a citizen of Jamaica born on 30 May 1957, applied to the entry certificate officer in Kingston on 10 February 1971 for an entry certificate to the United Kingdom so as to enable him to join his mother Mrs O. Buchanan.
