The Supplementary Benefit (Requirements) Amendment and Up-rating Regulations 19852ndAugust 1985
The Secretary of State for Social Services, in exercise of the powers conferred upon him by sections 2(2), 3(1) and 34(1)(a) of and paragraph 2(1) and (4) of Schedule 1 to the Supplementary Benefits Act 1976(b) and of all other powers enabling him in that behalf, with the consent of the Treasury (c), and, insofar as is required, after agreement by the Social Security Advisory Committee that proposals to make these regulations should not be referred to it (d), hereby makes the following regulations of which a draft has, in accordance with section 33(3) of that Act, been laid before Parliament and approved by a resolution of each House of Parliament:—
Citation, commencement and interpretation
1.—(1) These regulations may be cited as the Supplementary Benefit (Requirements) Amendment and Up-rating Regulations 1985 and shall come into operation on 25th November 1985 except for regulations 2(5)(d) which shall come into operation 5th August 1985 and regulations 2(4) and (6) which shall come into operation forthwith.
(2) In these regulations —
"Requirements Regulations" means the Supplementary Benefit (Requirements) Regulations 1983(e);
"Single Payments Regulations" means the Supplementary Benefit (Single Payments) Regulations 1981(f).

Amendment of and increase of amounts specified in the Requirements Regulations
2.—(1) Amounts specified in the Requirements Regulations shall be amended in accordance with the following paragraphs of this regulation, and the table of normal requirements of relevant persons and householders set out in paragraph 2(3) of Schedule 1 to the Supplementary Benefits Act 1976 shall have effect as modified by the Requirements Regulations as amended by paragraphs (2) and (3) of this regulation.
(2) In regulation 5 (normal requirements of relevant persons and householders) —
(a) in paragraph (1)(c) for "£0.20" there shall be substituted "£1.30";
(b) in paragraph (2)(d) for "£1.50" there shall be substituted "£0.70";
(c) in paragraph (3)(b) for "£0.10" there shall be substituted "£0.80"; and
(d) in paragraph (4)(b) for "£0.80" there shall be substituted "£0.35".
(3) In regulation 9 (modification of normal requirements of boarders) —
(a) in paragraph (7) for "£16.15" there shall be substituted "£17.30" and for "£32.30" there shall be substituted "£34.60";
(b) in paragraph (8) for "£32.30" there shall be substituted "£34.60"; and
(c) in paragraph (12) for "£8.50" there shall be substituted "£8.95" and —
(i) in sub-paragraph (a) in head (i) for "£20.60" there shall be substituted "£21.70" and in head (ii) for "£18.50" there shall be substituted "£19.40";
(ii) in sub-paragraph (b) in head (i) for "£10.30" there shall be substituted "£10.85" and in head (ii) for "£9.25" there shall be substituted "£9.70"; and
(iii) in sub-paragraph (c) for "£9.25" in head (i), "£5.55" in head (ii), "£4.75" in head (iii) and "£3.10" in head (iv) there shall be substituted "£9.70", "£5.85", "£5.00" and "£3.25" respectively.
(4) In regulation 11(2B) (b) (additional requirements) for "8(b)" there shall be substituted "8(a)".
(5) In regulation 12(2) (heating)—
(a) in sub-paragraph (b) for the words "and 7" there shall be substituted the words "7 and 7A";
(b) in sub-paragraph (c)(ii) for the word "paragraph" there shall be substituted the words "paragraphs 7A and";
(c) in sub-paragraph (g)(iii) for the words "both, of paragraphs 7" there shall be substituted the words "more than one of paragraphs 7, 7A"; and
(d) there shall be added the following sub-paragraph—
"(j) no amount shall be applicable to a householder under paragraph 3 unless that paragraph was applicable to him before 5th August 1985 and has been continuously applicable to him since that date or would have been so applicable to him but for the effect in his case of regulation 12(2)(f).".
(6) In regulation 14(7)(b) (housing requirements for certain persons listed in column 1 of Schedule 3) for "13" there shall be substituted "14".
(7) In regulation 16(1) (cost of maintenance and insurance) for "£1.80" there shall be substituted "£1.85".
(8) In regulation 22 (amount of deduction from housing requirements in respect of certain non-dependants) —
(a) in paragraph (4) —
(i) in sub-paragraph (c) in head (i) for "£2.35" there shall be substituted "£2.80", in head (ii) for "£6.60" there shall be substituted "£7.80" and in head (iii) for "£2.35" there shall be substituted "£2.80"; and
(ii) in sub-paragraph (e) for "£2.35" there shall be substituted "£2.80"; and
(b) in paragraph (10)(aa)(iv) for "£2.90", "£1.45", and "£0.35" there...
