The Minister of Agriculture, Fisheries and Food and the Secretary of State, acting jointly, in exercise of the powers vested in them under sections 1, 10, 11, 17(2), 20 and 84(3)(a) of the Diseases of Animals Act 1950(a) (as read with the Transfer of Functions (Animal Health) Order 1955(b)), and of all other powers enabling them in that behalf, hereby order as follows:—

Title, extent and interpretation

1.—(1) This order, which may be cited as the Swine Vesicular Disease Order 1972, shall apply throughout Great Britain.

(2) The Interpretation Act 1889(c) applies to the interpretation of this order as it applies to the interpretation of an Act of Parliament.

Extension of definition of disease

2. The definition of the expression "disease" in section 84(3)(a) of the Diseases of Animals Act 1950 is hereby extended to include swine vesicular disease for all the purposes of the Act, and section 17 of the Act (which makes provision for the slaughtering of any animal affected or suspected of being affected with any disease to which the section applies, or which has been exposed to the infection of any such disease) shall apply to that disease.

Application of existing provisions to swine vesicular disease

3.—(1) The provisions of the orders relating to foot-and-mouth disease mentioned in the Schedule to this order shall apply to swine vesicular disease as they apply to foot-and-mouth disease, and as if references therein to foot-and-mouth disease were references to swine vesicular disease, and any forms, notices or other documents for use under those provisions as applied by this order shall be subject to the necessary modifications and adaptations.

(2) In so far as any form, notice or other document was completed, served or made between the 11th December 1972 and the making of this order (being a form, notice or document purporting to be made under any of the said orders) the same shall, as from the making of this order, have effect as if completed, served or made under those orders as applied by this order.
