In the exercise of the powers conferred upon me by—

(1) paragraph (7) of section 70 of the Education (Scotland) Act, 1946(a),

(2) subsection (1) of section 71 of the said Act,

(3) subsections (2) and (3) of section 77 of the said Act as amended by section 9 of the Education (Scotland) Act, 1956(b), and

(4) sections 111 and 117, as read with section 118, of the Local Government Act, 1948(c),

and of all other powers enabling me in that behalf, I hereby make the following Regulations.

PART I

CONSTITUTION OF TRAINING AUTHORITIES

Incorporation of training authorities

1.—(1) With the general object of ensuring that teachers are adequately prepared for service in the educational establishments of Scotland, and for the particular purpose of carrying these Regulations and any other regulations relating to the training of teachers in Scotland into effect, governing bodies shall be and are hereby constituted under the following names, that is to say

"The Governors of Aberdeen College of Education",

"The Governors of Dundee College of Education",

"The Governors of Moray House College of Education",

"The Governors of Jordanhill College of Education.",

"The Governors of Craiglockhart College of Education",

"The Governors of Notre Dame College of Education" and

"The Governors of Dunfermline College of Physical Education, Aberdeen";

and a Council shall be and is hereby constituted under the name of "The Scottish Council for the Training of Teachers".

(2) Each of the said governing bodies and the Scottish Council shall be a body corporate having a perpetual succession and a common seal, with full power by and in such name—

(a) to sue and be sued;

(b) to enter into contracts or agreements for the purposes of their functions under these Regulations;

(c) to accept, hold and dispose of money or other moveable property for the said purposes, including moneys provided by Parliament or by education authorities;

(d) to accept any endowments, whether subject to special conditions or not, for the furtherance of the said purposes; and

(e) to invest any moneys and funds held by them which are not immediately required to be expended for the said purposes on or upon any investments for the time being authorised by law for the investment of trust funds, and to vary or transpose any investments held or made by them into investments of a nature so authorised;

and, subject to the provisions of these Regulations, with all other rights, powers and privileges of a body corporate.

(3) Notwithstanding the provisions of the last foregoing paragraph the governing bodies and the Scottish Council shall not have power to borrow money other than power to borrow for periods not exceeding six months on overdraft from their bankers.

Composition of training authorities

2.—(1) The governing bodies shall be composed in the manner prescribed in the First Schedule to these Regulations.

(2) The Scottish Council shall be composed in the manner prescribed in the Second Schedule to these Regulations.

Appointment of governors

3. Appointments to governing bodies, other than appointments by the Secretary of State, shall be made either at special or at ordinary meetings which shall be convened and conducted according to the ordinary rules and practice of the appointing bodies. The names of the persons appointed to be governors shall be intimated to the governing body.

Election of governors by teachers

4.—(1) The general qualification entitling a person to vote in the elections of teachers to be members of a governing body under the First Schedule shall be that the person is a certificated teacher in whole-time employment in or in connection with a school or further education establishment in Scotland on the first day of February upon which the said school or further education establishment is open in the year in which elections are to be held, or is a person not being a certificated teacher who is employed whole-time on the said day to teach in a further education establishment. In this Regulation and the Third Schedule the expression "whole-time employment" has, with the necessary modifications, the meaning attached to it by Regulation 14 or by Regulation 20, as the case may be, of the Teachers' Salaries (Scotland) Regulations, 1956(a).

(2) Subject to the provisions of paragraph (5) of this Regulation, the persons qualified to vote in the elections of teachers to be Governors of Aberdeen College of Education under paragraph 1 of the First Schedule, of Dundee College of Education under paragraph 2 of the First Schedule, of Moray House College of Education under paragraph 3 of the First Schedule and of Jordanhill College of Education under paragraph 4 of the First Schedule shall be persons who have the general qualification required under the last foregoing paragraph, who are employed on the said first day of February in a school or further education establishment in the northern area, the eastern area, the south-eastern area and the south-western area respectively, but who are not certificated teachers entitled to vote in the elections of teachers under paragraph 5, or paragraph 6 or paragraph 7 of the First Schedule.

(3) Subject to the provisions of paragraph (5) of this Regulation, the persons qualified to vote in the elections of teachers to be Governors of Craiglockhart College of Education under paragraph 5 of the First Schedule and of Notre Dame College of Education under paragraph 6 of the First Schedule shall be certificated women teachers having the general qualification required under paragraph (1) of this Regulation (other than certificated women teachers entitled to vote in the election of teachers under paragraph 7 of the First Schedule) who are approved as regards their religious belief and character by the Scottish Hierarchy of the Roman Catholic Church and

were employed on the said first day of February in a school or further education...
