The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 19801and now vested in the Secretary of State for Transport2:

S-1 This Order may be cited as the A40 Trunk Road (Gloucestershire...

1. This Order may be cited as the A40 Trunk Road (Gloucestershire Border to Ross-on-Wye, Herefordshire) (Detrunking) Order 2009 and shall come into force on 1st April 2009.

S-2 In this Order - “principal road” as a classification for a...

2. In this Order -

(i) “principal road” as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State;

(ii) “the trunk road” means the A40 Trunk Road; and

(iii) “the plan” means the plan folio, numbered HA 10/PS/312, marked “The A40 Trunk Road (Gloucestershire Border to Ross-on-Wye, Herefordshire) (Detrunking) Order 2009 ”, signed by authority of the Secretary of State for Transport and deposited at the Department for Transport, Information Management Division, Ashdown House, Sedlescombe Road North, St Leonards-on-Sea, East Sussex, TN37 7GA.

3. The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a principal road from the date on which the Order comes into force.

THE SCHEDULE

LENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD

The length of the trunk road ceasing to be a trunk road starts from the Herefordshire/Gloucestershire border (marked “A” on the plan) and continues in a north westerly direction to a point 44 metres south east of the centre of the A40/A449 Over Ross roundabout at Ross-on-Wye, Herefordshire (marked “B” on the plan), all in the area of Herefordshire Council. It is shown by broad black dashes on the plan and is approximately 9 kilometres in length.
