The Welsh Ministers, as traffic authority for the relevant length of the A466 Trunk Road, in exercise of the powers conferred upon them by sections 1(1), 2(1), 2(2) and 124(1)(d) of, and paragraph 27(1) of Schedule 9 to, the Road Traffic Regulation Act 1984( 1), and after consultation with the Chief Officer of Gwent Police, make this Order.

Title, Commencement and Interpretation

1. The title of this Order is the A466 Trunk Road (Newhouse Roundabout to High Beech Roundabout, Chepstow, Monmouthshire) (Red Route Clearway) Order 2020 and it comes into force on 27 February 2020.

2. In this Order:

“the trunk road”(“y gefnffordd”) means the A466 London to Fishguard Trunk Road.

Prohibition

3. Except as provided in article 4, no person may cause or permit any vehicle to stop on the lengths of the trunk road specified in the Schedule to this Order.

Exemptions

4. Nothing in article 3 prohibits a vehicle stopping on the lengths of the trunk road specified in the Schedule to this Order for as long as may be necessary to enable:

(a) the vehicle to be used in connection with any of the following operations:

(i) building, industrial or demolition operation;

(ii) the removal of any obstruction to traffic;

(iii) the maintenance, improvement or reconstruction of the said lengths of the trunk road;

(iv) the laying, erection, alteration or repair in, or in land adjacent to, the said lengths of the trunk road of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or any electronic communications apparatus as defined in paragraph 5 of Schedule 3A to the Communications Act 2003( 2);

(b) the vehicle to be used in the service of a local authority or a water authority in pursuance of statutory functions;

(c) the vehicle to be used for fire brigade, ambulance or police purposes; and,

(d) the vehicle to stop when the person in control of it:

(i) is required by law to stop;

(ii) is obliged to stop in order to avoid an accident;

(iii) is prevented from proceeding; or

(iv) is acting upon the direction, or with the permission of, a police constable, police community support officer or civil enforcement officer.
