The Argyll and Bute Council (Pilotage Powers) Order 2007

Coming into force 1st March 2007

Whereas Argyll and Bute Council1is a harbour authority within the meaning of the Pilotage Act 19872(“the 1987 Act”) for the harbour of Campbeltown but is not a competent harbour authority within the meaning of the 1987 Act;

And whereas Argyll and Bute Council wishes to be treated as a competent harbour authority for the purposes of the 1987 Act;

And whereas the Scottish Ministers have informed the persons they consider might be affected by this Order, in accordance with section 1(7) of the 1987 Act, and the making of the Order is not opposed;

Now therefore the Scottish Ministers, on the application of Argyll and Bute Council, in exercise of the powers conferred by section 1(4) of the 1987 Act3and of all other powers enabling them in that behalf, hereby make the following Order:

S-1 Citation, commencement and interpretation

1.—(1) This Order may be cited as the Argyll and Bute Council (Pilotage Powers) Order 2007 and shall come into force on 1st March 2007.

(2) In this Order, “the harbour of Campbeltown” means the area described in section 38 (limits of the harbour of Campbeltown) of the Campbeltown Harbour and Burgh Act 18464.

2. Argyll and Bute Council shall be a competent harbour authority in respect of the harbour of Campbeltown for the purposes of the Pilotage Act 1987.

This Order provides that Argyll and Bute Council shall be a competent harbour authority for the purposes of the Pilotage Act 1987 in respect of the harbour of Campbeltown.

The applicant for the Order is Argyll and Bute Council, Manse Brae, Lochgilphead, Argyll, PA31 8RD.


(1) A council constituted under section 2 of the Local Government etc. (Scotland) Act 1994 (c. 39).
(3) The functions conferred on the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
(4) 1846 c.ccclxiv (9 & 10 Vict.).
