THE Control of Pollution (Continuation of Byelaws) (Scotland) Order 1991

The Secretary of State, in exercise of the powers conferred on him by section 33(2) of the Control of Pollution Act 19741and of all powers enabling him in that behalf, hereby makes the following Order:
Citation, commencement and extent
1. This Order may be cited as the Control of Pollution (Continuation of Byelaws) (Scotland) Order 1991, shall come into force on 31st May 1991 and shall extend to Scotland only.
Continuation of byelaws
2. The Byelaw regarding vessels provided with sanitary appliances on Loch Lomond and Loch Eck which was made by the Clyde River Purification Board by virtue of section 25(1)(c) of the Rivers (Prevention of Pollution) (Scotland) Act 19512on 1st February 1968 and confirmed by the Secretary of State for Scotland on 14th May 1969 shall have effect as if made by virtue of section 33(1) of the Control of Pollution Act 1974.

This Order, which extends to Scotland only, makes provision for continuing in effect a Byelaw made by Clyde River Purification Board under section 25(1)(c) of the Rivers (Prevention of Pollution) (Scotland) Act 1951 regulating the keeping and use of vessels provided with sanitary appliances on Loch Lomond and Loch Eck. Section 25(1)(c) has now been replaced by section 33(1) of the Control of Pollution Act 1974 and the Order provides for the Byelaw to have effect as if made under the 1974 Act provision.
By virtue of section 33(4) of the 1974 Act, contravention of the Byelaw attracts a fine, on summary conviction, not exceeding level 4 on the standard scale.
