The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 36(2) of the Health (Tobacco, Nicotine etc. and Care) (Scotland) Act 20161.

S-1 Citation and commencement

Citation and commencement

1. These Regulations may be cited as the Health (Tobacco, Nicotine etc. and Care) (Scotland) Act 2016 (Commencement No. 3) Regulations 2018 and come into force on 19th March 2018.

S-2 Appointed day

Appointed day

2. 19th March 2018 is the day appointed for the coming into force of section 33 (duty to provide or secure communication equipment) of the Health (Tobacco, Nicotine etc. and Care) (Scotland) Act 2016.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations bring into force section 33 (duty to provide or secure communication equipment) of the Health (Tobacco, Nicotine etc. and Care) (Scotland) Act 2016 (“the Act”).

Regulation 2 provides that the day appointed for that section to come into force is 19th March 2018.

The Bill for the Act received Royal Assent on 6th April 2016. Sections 34, 35, 36 and 37 of the Act came into force the following day.
