The Higher Education (Freedom of Speech) Act 2023 (Commencement No. 1) Regulations 2023

The Secretary of State makes these Regulations in exercise of the powers conferred by section 13(3) and (4) of the Higher Education (Freedom of Speech) Act 20231.

S-1 Citation and extent

1.—(1) These Regulations may be cited as the Higher Education (Freedom of Speech) Act 2023 (Commencement No. 1) Regulations 2023.

(2) These Regulations extend to England and Wales only.

S-2 Provisions coming into force on 14th August 2023

Provisions coming into force on 14th August 2023

2. The following provisions of the Higher Education (Freedom of Speech) Act 2023 come into force on 14th August 2023—

(a) section 10;

(b) section 11 insofar as it relates to the provision set out in paragraphs (c) and (d);

(c) paragraph 1 of the Schedule insofar as it relates to the provision set out in paragraph (d);

(d) paragraph 12 of the Schedule.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations bring into force provisions of the Higher Education (Freedom of Speech) Act 2023 (c. 16)(“the Act”) relating to the role of the Director for Freedom of Speech and Academic Freedom at the Office for Students.

Regulation 2 lists the provisions of the Act that come into force on 14th August 2023.
