case XLII. the king v varley (Forging the impiesaion of the current com on a piece of metal so irregular that it will not pass, is not high treason ; for the crime is incomplete.) [S C 2 Wm. Bl. 682, 1 East, P C 164.] Willam Varley was found guilty at the Lent Assizes for York, in the year 1771, of forging and counterfeiting a forged and false coin to the similitude of half-a-guiiiea. It appeared in evidence, That he had counterfeited the impression of half-a-gumea on a piece of gold which was previoiraly hammered, and was not round, nor would (a) In. the case of Hotkam v. III. it was aid by the Court, That, no precise technical words are required in a deed to make a stipulation a condition precedent or subsequent ; neither does it depend upon its being prioi or posterior in the deed , but that it must depend on the nature of the contract., and the acts to be performed by the parties. - I Term Rep B R. 645.
