case LXXXIII. the king v william snow. (H on any sudden quarrel, blows pass, without any intention to kill or injure another materially, and in the course of the scuffle, after the parties are heated by the contest, one kill tie other with a deadly weapon, it is only manslaughter. See the case of Jehn Brown, ante, p 148, and the cases there cited ) [S C 1 East, P. C 244.] The following case was submitted to the consideration of the Twelve Judges, at Sarjeanfct'-Inn Hall, on tie first day of Michaelmas Term 1776, by Mr Justice Willes. At the preceding Summer Assize for Northampton, William Snow was indicted for (a) See Dr. Doet&s case, Old Bailey February 1777, post, 157, where the Earl of desterfield, the supposed obligor of the forged bond, was admitted to disprove his signature, on producaag a release frrn Mr, Fletcher, the supposed obligee ; and Rex v John Tsytor, Old Bailey October Session 1779, post. It was qustionable fiorn the evidence, whether the ^ime amounted to muroler, or to manslaughter; and Mr. Serjeant Vaughan, at the request otthei learned Judge, came into Court, and argued the point of law in iavour of the prisoner with great ability. The Juiyv however, thought that there appeared to be an implied malice La the prisoner's behaviour, [152] and they accordingly found fcm gvulty of murder.(o) But the judgment was respited, in order to take the pinion of the Judges, Whether this conviction was warranted by the circumstances of the case ? Case William Snow was a shoemaker; and Thomas Palmer a labouring man. The=y lived m the same neighbourhood, aad at no great distance from each other. On the afternoon of the day mentioned irt the indictment, the prisoner, very much tntossicated by liqmor,, passed accidentally by the house of the deceased's mother, while he was thatching an adjacent barn. They entered into conversation , but on the prisoner's abusing the mother and sister of the deceased, very high words arose on both sides, and they placed themselves in a posture to fight.
