The First Secretary of State, in exercise of the powers conferred upon him by section 36(2) of the Representation of the People Act 19831and after consulting the Electoral Commission pursuant to section 7(2)(e) of the Political Parties, Elections and Referendums Act 20002, hereby makes the following Rules:

S-1 Citation, commencement and extent

1.—(1) These Rules may be cited as the Local Elections (Principal Areas) (Amendment) (No. 2) (England and Wales) Rules 2004.

(2) These Rules come into force on 30th April 2004.

(3) These Rules extend to England and Wales.

S-2 Amendment of principal areas rules

Amendment of principal areas rules

2.—(1) The rules in Schedule 3 to the Local Elections (Principal Areas) Rules 19863shall be amended as follows.

(2) In rule 24(5A), for “this paragraph and paragraph”, substitute “paragraph (5) above and paragraphs”.

(3) In rule 39(1A), for “sub-paragraphs (d) and (e)”, substitute “sub-paragraphs (a) to (d)”.

(4) In the Appendix of Forms, in the directions as to printing the ballot paper, in paragraph 2(b), after the words “particulars of the candidates”, insert “and the horizontal rules separating the particulars of the candidates”.

These Rules correct errors in Schedule 3 to the Local Elections (Principal Areas) Rules 1986, which was inserted by the Local Elections (Principal Areas) (Amendment) (England and Wales) Rules 2004. The errors involved two incorrect cross references and the omission of a few words from the directions as to how ballot papers are to be printed.
