The National Health Service (Functions of Strategic Health Authorities and Primary Care Trusts and Administration Arrangements) (England) (Amendment No.2) Regulations 2007

The Secretary of State for Health makes the following Regulations in exercise of the powers conferred by sections 7, 8, 73, 272(7) and (8) and 273(1) and (4) of the National Health Service Act 20061:
Citation, commencement, interpretation and application
1.—(1) These Regulations may be cited as the National Health Service (Functions of Strategic Health Authorities and Primary Care Trusts and Administration Arrangements) (England) (Amendment No. 2) Regulations 2007 and shall come into force on 1st October 2007.
(2) In these Regulations, “the principal Regulations” means the National Health Service (Functions of Strategic Health Authorities and Primary Care Trusts and Administration Arrangements) (England) Regulations 20022.
(3) These Regulations apply in relation to England.
Amendment of regulation 2 of the principal Regulations
2. In regulation 2(1) of the principal Regulations (interpretation), after the definition of “the 2002 Act”, insert—
““the 2006 Act” means the National Health Service Act 2006;”.
Amendment of regulation 6 of the principal Regulations
3. At the end of regulation 6 of the principal Regulations (limitations and restrictions on the exercise of functions relevant to both Strategic Health Authorities and Primary Care Trusts), add the following paragraph—
“6 The Secretary of State’s function under paragraph 11(3) of Schedule 3 to the 2006 Act (remuneration, pensions etc of members) is to be exercisable by a Strategic Health Authority or Primary Care Trust only in relation to an Executive Committee appointed under regulation 9(1) of the Primary Care Trusts (Membership, Procedure and Administration Arrangements) Regulations 20003(appointment of committees and sub-committees).”.
