The National Minimum Wage (Amendment) Regulations 2013

Coming into force 1st October 2013

A draft of these Regulations was laid before Parliament in accordance with section 51(5) of the National Minimum Wage Act 19981and approved by a resolution of each House of Parliament.

The Secretary of State, in accordance with sections 5(4) and 6(3) of the Act, has laid a report before each House of Parliament containing a statement of reasons for the decision to act in a manner falling within paragraphs (b) and (d) of section 5(4).

The Secretary of State, in exercise of the powers conferred by sections 1(3), 2, 3 and 51 of the National Minimum Wage Act 1998, makes the following Regulations.

S-1 Citation and commencement

1.—(1) These Regulations may be cited as the National Minimum Wage (Amendment) Regulations 2013.

(2) These Regulations come into force on 1st October 2013.

S-2 Amendments to the National Minimum Wage Regulations 1999

2.—(1) The National Minimum Wage Regulations 19992are amended as follows.

(2) In regulation 11 (the rate of the national minimum wage), for “£6.19” substitute “£6.31”.

(3) In regulation 13 (workers who qualify for the national minimum wage at a different rate)—

(a)

(a) in paragraph (1) for “£4.98” substitute “£5.03”;

(b)

(b) in paragraph (2) for “£3.68” substitute “£3.72”;

(c)

(c) in paragraph (3) for “£2.65” substitute “£2.68”.

(4) In regulation 36(1) (amount permitted to be taken into account where living accommodation is provided), for “£4.82” substitute “£4.91”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the National Minimum Wage Regulations 1999 (“the Principal Regulations”). The Regulations come into force on 1st October 2013.

Regulation 2(2) increases the rate of the national minimum wage for workers who are aged 21 or over from £6.19 to £6.31 per hour (regulation 11 of the Principal Regulations).

Regulation 2(3)(a) increases the rate for workers who are aged 18 or over (but not yet aged 21) from £4.98 to £5.03 per hour (regulation 13(1) of the Principal Regulations).
