HIGH COURT OF ADMIRALTY OF ENGLAND
the "pepperell"-(Jordan) Master December 8, 1855-Collision-Fishing cutter, with trawl down-Rate of speed during dark night -In case of collision between a cutter with her trawl down, and a ship under sad, the presumption is againt the latter sailing at six and a half knots on a very dark night, and aware that she was crossing a fishing-ground. This was a suit promoted by the carrier cutter " Leander " against the American ship " PeppereH," to recover the loss arising from a collision between them in the North Sea, about twenty miles to the eastward of Smith's Knowl, at 1 45 A m , on the 16th of September last. The cutter was engaged in fishing with her trawl down when she was rmn into by the " Pepperell." Haggard and Jenner appeared for the " Leander " Addams and Chirteis for the " Pepperell " Dr. Luahtngton . This is a suit brought by the fishing cutter w' Leander," which was ran into by the " Pepperell," an American vessel, of the burden of 670 tons, early on the morning of the 16th of September.
