The Plant Health (Phytophthora ramorum) (Scotland) Amendment Order 2007

Laid before the Scottish Parliament 6th September 2007

Coming into force 30th September 2007

The Scottish Ministers make the following Order in exercise of the powers conferred by sections 2, 3(1), (2), (3) and (4) and 4(1) of the Plant Health Act 19671, as read with section 20 of the Agriculture (Miscellaneous Provisions) Act 19722, and all other powers enabling them to do so.

S-1 Citation and commencement

1. This Order may be cited as the Plant Health (Phytophthora ramorum) (Scotland) Amendment Order 2007 and comes into force on 30th September 2007.

2. The Plant Health (Phytophthora ramorum) (Scotland) Order 20043is amended in accordance with articles 3 to 6.

S-3 Amendment of article 5 (movement of susceptible material originating in the USA or any other third country)

3. In article 5(1), in the final line omit the words after “plant passport”.

S-4 Amendment of article 6 (movement of susceptible material originating in Scotland and elsewhere in the European Community or Switzerland)

4. In article 6(2), for “from its place of production” substitute “within the European Community”.

5. In article 15 (offences)–

(a) for sub-paragraph (a) of paragraph (1) substitute–

“(a)

“(a) subject to paragraph (1A), contravenes or fails to comply with article 3, 4, 5(1), 6, 7(1) or (3), 8(1) or 11(1);”; and

(b) after paragraph (1), insert–

S-1A

“1A Paragraph (1)(a) does not apply where an article of any description is landed in Scotland in contravention of a prohibition in this Order4.”.
