The Product Security and Telecommunications Infrastructure Act 2022 (Commencement No. 1) Regulations 2023

The Secretary of State makes these Regulations in exercise of the power conferred by section 79(2) of the Product Security and Telecommunications Infrastructure Act 20221.

S-1 Citation and interpretation

1.—(1) These Regulations may be cited as the Product Security and Telecommunications Infrastructure Act 2022 (Commencement No. 1) Regulations 2023.

(2) In these Regulations “the Act” means the Product Security and Telecommunications Infrastructure Act 2022.

2. The following provisions of the Act come into force on 7th February 2023—

(a) section 57 (rights under the electronic communications code to share apparatus);

(b) section 60 (power to fly lines from apparatus kept by another operator);

(c) section 75 (meaning of “the electronic communications code”).

3. The following provisions of the Act come into force on 17th April 2023—

(a) section 58 (upgrading and sharing of apparatus: subsisting agreements);

(b) section 59 (upgrading and sharing of apparatus installed before 29 December 2003).

Explanatory Note

(This note is not part of the Regulations)

These Regulations bring specified provisions of the Product Security and Telecommunications Infrastructure Act 2022 (c. 46)(“the Act”) into force. Regulation 2 brings into force on 7th February 2023 sections 57, 60 and 75 of the Act. Regulation 3 brings into force on 17th April 2023 sections 58 and 59 of the Act.

Sections 57 to 60 of the Act insert new provisions into, or otherwise amend, the electronic communications code (the “code”) set out in Schedule 3A to the Communications Act 2003 (c. 21), as modified by Schedule 2 to the Digital Economy Act 2017 (c. 30)for transitional purposes.

Section 57 of the Act provides for a code right for telecommunications operators to share electronic communications apparatus with other operators and provides for related code rights. Sections 58 and 59 of the Act provide for upgrading and sharing rights in relation to such apparatus. Section 60...
