Her Majesty, in exercise of the powers conferred on Her by section 84(4) of the Energy Act 20041is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:–

S-1 This Order may be cited as the Renewable Energy Zone...

1. This Order may be cited as the Renewable Energy Zone (Designation of Area) Order 2004, and shall come into force on 15 November 2004.

The rights to which section 84 of the Energy Act 2004 (exploitation of areas outside the territorial sea for energy production) applies shall be exercisable in those areas of the sea specified in the Schedule to the Merchant Shipping (Prevention of Pollution)(Limits) Regulations 19962.

This Order designates the area of the Renewable Energy Zone, an area of the sea, beyond the United Kingdom’s territorial sea, which may be exploited for energy production. The Renewable Energy Zone will be co-extensive with the area within which the United Kingdom already exercises jurisdiction with respect to marine environmental matters, in accordance with Part XII of the United Nations Convention on the Law of the Sea. The co-ordinates for the Renewable Energy Zone are those set out in the Schedule to the Merchant Shipping (Prevention of Pollution)(Limits) Regulations 1996, as amended by the Merchant Shipping (Prevention of Pollution)(Limits) Regulations 1997. A map of the Renewable Energy Zone is available at www.ukho.gov.uk it can be found at “Law of the Sea”, then link to “UK limits”, and can be downloaded at up to A3 size. Copies can be obtained from The Law of the Sea Division, UK Hydrographic Office, Taunton, TA1 2DN.
