The Renting Homes (Amendment) (Wales) Act 2021 (Commencement) Order 2022

The Welsh Ministers make the following Order in exercise of the power conferred on them by section 19(2) of the Renting Homes (Amendment) (Wales) Act 20211.

Title

1. The title of this Order is the Renting Homes (Amendment) (Wales) Act 2021 (Commencement) Order 2022.

S-2 Appointed day

Appointed day

2. 1 December 2022 is the appointed day for the coming into force of paragraph 28 of Schedule 6 to the Renting Homes (Amendment) (Wales) Act 2021.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order is the only commencement order made by the Welsh Ministers under the Renting Homes (Amendment) (Wales) Act 2021 (asc 3) (“the Act”) and it brings paragraph 28 of Schedule 6 to the Act into force.

The Act makes provision about security of occupation under the Renting Homes (Wales) Act 2016 (anaw 1), miscellaneous provisions relating to occupation contracts and other connected provisions.

Sections 15, 17, 19 and 20 of the Act came into force on 8 April 2021 (the day after the day on which the Act received Royal Assent) in accordance with section 19(1) of the Act. The remaining provisions of the Act, other than paragraph 28 of Schedule 6, came into force on 7 June 2021 (two months after the day on which the Act received Royal Assent) in accordance with section 19(2) and (3) of the Act.

Article 2 of this Order commences paragraph 28 of Schedule 6 to the Act on 1 December 2022.

Paragraph 28 of Schedule 6 to the Act amends the Renting Homes (Fees etc.) (Wales) Act 2019 (anaw 2) (“the 2019 Act”) so as to—

(a) omit paragraph (b) of section 6 (application of sections 2 to 5 of the 2019 Act to pre-existing requirements and contracts), and

(b) omit section 25 (power to make transitional provision in respect of assured tenancies).
