The Riding Establishments Act,
1939
THIS
Act, which comes into operation on the 1St
January,
1940, and does
not
extend to
Northern
Ireland
or
Scotland, provides for the inspection of riding establishments
on behalf of a local authority, and also for the protection of
horses let
out
on hire for riding.
A local authority may authorize any duly registered
veterinary surgeon to inspect any premises which
they
have
reason to believe are used asariding establishment.
The
veterinary surgeon has.
the
right at all reasonable
times to enter those premises
and
to inspect
such
parts of
the
premises, and
such
horses found thereon, as he may
consider necessary for the purpose of ascertaining whether
any offence
under
the Act is being or has been committed.
The
authorization from the local authority
must
be in writing
and
must
be produced by the veterinary surgeon if so required
(section I (I
».
Prosecutions
under
the
Act can only be instituted by
a local authority,
but
such
an authority is
not
to
bring
a
prosecution unless they have received and considered areport
from a duly registered veterinary surgeon.
The
report
must
be
such
as they may think appropriate in
the
circumstances
of the case (section 2 (2».
Auseful provision with regard to proving a case is made
by section 2(3) to
the
effect
that
any document stating
that
a local authority have received and considered a
report
as
mentioned above, shall, if it purports to be signed by an
officer of the authority purporting to have authority to sign
the
document, be evidence
that
the authority have received
and
considered such areport as required by the Act before
giving consent to the prosecution.
Section 2is
