The Social Security (Croatia) Amendment Regulations 2013

Made 12th June 2013

Laid before Parliament 20th June 2013

Coming into force 1st July 2013

The Secretary of State for Work and Pensions makes the following Regulations in exercise of the powers conferred upon him by sections 123(1)(a) and (d), 135(1) and (2), 137(1) and 175(1), (3) and (4) of the Social Security Contributions and Benefits Act 19921, sections 4(5) and (12), 35(1) and 36(2) and (4) of the Jobseekers Act 19952, section 115(3), (4) and (7) of the Immigration and Asylum Act 19993, sections 1(5)(a) and 17(1) of the State Pension Credit Act 20024and sections 4(3), 24 and 25(2), (3) and (5) of the Welfare Reform Act 20075.

He has consulted with such organisations which appear to him to be representative of the authorities concerned with these Regulations in so far as they relate to housing benefit6.

The Social Security Advisory Committee has agreed that the proposals to make these Regulations should not be referred to it7.

1. These Regulations are to be cited as the Social Security (Croatia) Amendment Regulations 2013 and shall come into force on 1st July 2013.

S-2 Amendment of the Income Support (General) Regulations 1987

2.—(1) Regulation 21AA of the Income Support (General) Regulations 19878(special cases: supplemental – persons from abroad) is amended as follows.

(2) In paragraph (4) for sub-paragraph (f) substitute—

“(f)

“(f) a person who is treated as a worker for the purpose of the definition of “qualified person” in regulation 6(1) of the Immigration (European Economic Area) Regulations 20069pursuant to—

(i) regulation 6 of the Accession (Immigration and Worker Authorisation) Regulations 200610(right of residence of a Bulgarian or Romanian who is an “accession State national subject to worker authorisation”), or

(ii) regulation 5 of the Accession of Croatia (Immigration and Worker Authorisation) Regulations 201311(right of residence of a Croatian who is an “accession State national subject to worker authorisation”);”.

3.—(1) Regulation 85A of the Jobseeker’s Allowance Regulations 199612(special cases: supplemental – persons from abroad) is amended as follows.

(2) In paragraph (4) for sub-paragraph (f) substitute—

“(f)

“(f) a person who is treated as a worker for the purpose of the definition of “qualified person” in regulation 6(1) of the Immigration (European Economic Area) Regulations 2006 pursuant to—

(i) regulation 6 of the Accession (Immigration and Worker Authorisation) Regulations 2006 (right of residence of a Bulgarian or Romanian who is an “accession State national subject to worker authorisation”), or

4.—(1) Regulation 2 of the State Pension Credit Regulations 200213(persons not in Great Britain) is amended as follows.

(2) In paragraph (4) for sub-paragraph (f) substitute—

“(f)

“(f) a person who is treated as a worker for the purpose of the definition of “qualified person” in regulation 6(1) of the Immigration (European Economic Area) Regulations 2006 pursuant to—

(i) regulation 6 of the Accession (Immigration and Worker Authorisation) Regulations 2006 (right of residence of a Bulgarian or Romanian who is an “accession State national subject to worker authorisation”), or

(ii) regulation 5 of the Accession of Croatia (Immigration and Worker Authorisation) Regulations 2013 (right of residence of a Croatian who is an “accession State national subject to worker authorisation”);”.

5.—(1) Regulation 10 of the Housing Benefit Regulations 200614(persons from abroad), is amended as follows.

(2) In paragraph (3B) for sub-paragraph (f) substitute—

“(f)

“(f) a person who is treated as a worker for the purpose of the definition of “qualified person” in regulation 6(1) of the Immigration (European Economic Area) Regulations 2006 pursuant to—

(i) regulation 6 of the Accession (Immigration and Worker Authorisation) Regulations 2006 (right of residence of a Bulgarian or Romanian who is an “accession State national subject to worker authorisation”), or

(ii) regulation 5 of the Accession of Croatia (Immigration and Worker Authorisation) Regulations 2013 (right of residence of a Croatian who is an “accession State national subject to worker authorisation”);”.

(2) In paragraph (4A) for sub-paragraph (f) substitute—

“(f)

“(f) a person who is treated as a worker for the purpose of the definition of “qualified person” in regulation 6(1) of the Immigration (European Economic Area) Regulations 2006 pursuant to—

(i) regulation 6 of the Accession (Immigration and Worker Authorisation) Regulations 2006 (right of residence of a Bulgarian or Romanian who is an “accession State national subject to worker authorisation”), or

(ii) regulation 5 of the Accession of Croatia (Immigration and Worker Authorisation) Regulations 2013 (right of residence of a Croatian who is an “accession State national subject to worker authorisation”);”.
