The Teachers’ Superannuation and Pension Scheme (Scotland) Amendment Regulations 2016

Laid before the Scottish Parliament 1st February 2016

Coming into force 1st April 2016

The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 9 and 12 of, and Schedule 3 to, the Superannuation Act 1972 (“the 1972 Act”)1and section 1(1) and (2)(d) of, and paragraph 4(b) of Schedule 2 to, the Public Service Pensions Act 2013 (“the 2013 Act”)2and all other powers enabling them to do so.

In accordance with section 9(5) of the 1972 Act, the Scottish Ministers consulted with representatives of education authorities and teachers and with such other persons likely to be affected by these Regulations as appeared to them to be appropriate.

In accordance with section 21(1) of the 2013 Act, the Scottish Ministers consulted the representatives of such persons as appeared to them likely to be affected by these Regulations.

In accordance with section 9(1) of the 1972 Act3and section 3(5) of the 2013 Act, these Regulations are made with the consent of the Treasury.

1.—(1) These Regulations may be cited as the Teachers’ Superannuation and Pension Scheme (Scotland) Amendment Regulations 2016.

(2) These Regulations come into force on 1st April 2016 and, with the exception of regulation 7, have effect from 1st April 2015.
