The Town and Country Planning (Prescribed Date) (Scotland) Regulations 2007

The Scottish Ministers, in exercise of the powers conferred by section 26AA(2)(a) of the Town and Country Planning (Scotland) Act 19971and of all other powers enabling them in that behalf, hereby make the following Regulations:

S-1 Citation and commencement

1. These Regulations may be cited as the Town and Country Planning (Prescribed Date) (Scotland) Regulations 2007 and shall come into force on 1st April 2007.

2. The date prescribed for the purposes of section 26AA(2) of the Town and Country Planning (Scotland) Act 1997 is 1st April 2010.

These Regulations specify 1st April 2010 as the date prescribed for the purposes of section 26AA(2) of the Town and Country Planning (Scotland) Act 1997 (“the Act”). The effect is that 1st April 2010 is, in the absence of a prior grant or refusal of planning permission under section 31A of the Act, the earliest date on which planning permission would be required for the operation of a marine fish farm using equipment in place on or before the date on which section 3(1)(c) comes into force (1st April 2007).
