The Transmissible Spongiform Encephalopathies (Wales)(Amendment) Regulations 2009

The Welsh Ministers have been designated1for the purposes of section 2(2) of the European Communities Act 19722in relation to measures in the veterinary and phytosanitary fields for the protection of public health.

The Welsh Ministers make the following Regulations under the powers conferred by section 2(2) of the European Communities Act 1972.

The Welsh Ministers have carried out the consultation required by Article 9 of Regulation (EC) No. 178/2002of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety3.

1. The title of these Regulations is The Transmissible Spongiform Encephalopathies (Wales) (Amendment) Regulations 2009; they apply in relation to Wales and come into force on 25 February 2009.

2. The Transmissible Spongiform Encephalopathies (Wales) Regulations 20084(“the principal Regulations”) are amended in accordance with regulation 3.

3. The Welsh version of the principal Regulations is amended as follows—

(a) in regulation 15(1)(c) replace “sydd ag” with “a chanddo yn ei feddiant, neu i gyflenwr,” and after the third time “anifeiliaid” appears, delete “yn ei feddiant”;

(b) in paragraph 5(6) of Schedule 3 replace “rheoliad” with “paragraff”; and

(c) in paragraph 3(2) of Schedule 6 replace “(d)” with “(ch)”.

These Regulations amend The Transmissible Spongiform Encephalopathies (Wales) Regulations 2008 (S.I. 2008/3154 (W.282)) (“the principal Regulations”) which enforce Regulation (EC) No. 999/2001of the European Parliament and of the Council laying down rules for the prevention, control and eradication of certain transmissible spongiform encephalopathies (OJNo. L147, 31.5.2001, p.1) as amended.

The Welsh version of the principal Regulations is amended to: include a reference to “cyflenwr” (“supplier”) (regulation 15(1)(c)); replace the word “rheoliad” with “paragraff” (paragraph 5(6) of Schedule 3) and replace “(d)” with “(ch)” (paragraph 3(2) of Schedule 6).

A regulatory impact assessment on the effect of this instrument on the costs of business has not been prepared.
