FORMS OF NOTICES

The Secretary of State for the Environment in exercise of the powers conferred on him by sections 18(1) and (2), 19(a), 287 and 290 and paragraphs 11(2), (3) and (4), 12(1), (2) and (3) and 17(4) of Schedule 4(a) to the Town and Country Planning Act 1971(b), and of all other powers enabling him in that behalf, hereby makes the following regulations:—

PART I

APPLICATION, CITATION, COMMENCEMENT AND INTERPRETATION

Application

1. These regulations shall apply only to Greater London.

Citation and commencement

2. These regulations may be cited as the Town and Country Planning (Local Plans for Greater London) Regulations 1974 and shall come into operation on 7th October 1974.

Interpretation

3.—(1) In these regulations:—

"the Act" means the Town and Country Planning Act 1971;

"action area" means an action area within the meaning of section 7(5) of the Act;

"certified copy" means a copy certified by the proper officer of the local planning authority or, in the case of a joint local plan, by the proper officer of any of the local planning authorities preparing the plan, as being a true copy;

"document" includes a map, diagram, illustration or other descriptive matter in any form, and also includes where appropriate, a copy of a document;

"duly made" in relation to objections means duly made in accordance with a notice given or served under these regulations;

"Greater London development plan" has the meaning assigned to it in section 290(1) of the Act;

"G.L.C. action area" has the meaning assigned to it by paragraph 8(1) of Schedule 4 to the Act;

"joint local plan" means a local plan prepared by two or more local planning authorities;

"local plan" means a local plan within the meaning of section 11 of the Act;

"local planning authority" means the Greater London Council, the council of a London borough or the Common Council of the City of London, as the case may be;

"notice by advertisement" means a notice published in the London Gazette and in each of two successive weeks in at least one local newspaper circulating in the locality in which the land to which the notice relates is situated;

"proper officer" means, in relation to the certification of a document as a true copy, the officer appointed for that purpose by the local planning autho-

rity or, in the case of a joint local plan, any of the local planning authorities concerned;

"written statement" means the written statement required by paragraph 11(2) of Schedule 4 to the Act.

(2) In relation to a joint local plan reference in these regulations (except in this regulation and in regulations 25 and 26) to a local planning authority shall be read as references to the local planning authorities concerned save that in regulation 7 the reference shall not include a reference to the Greater London Council.

(3) A regulation or schedule referred to in these regulations only by number means the regulation or schedule so numbered in these regulations.

(4) The Interpretation Act 1889(a) shall apply for the interpretation of these regulations as it applies for the interpretation of an Act of Parliament.

PART II

PUBLICITY IN CONNECTION WITH THE PREPARATION OF LOCAL PLANS:

SALE OF DOCUMENTS AND PRESCRIBED PERIOD FOR MAKING REPRESENTATIONS

Sale of copies of documents made public for the purposes mentioned in paragraph 12(1)(a) of Schedule 4 to the Act

4. The local planning authority shall, in such particular cases as the Secretary of State may direct, provide persons making a request in that behalf with copies of any plan or other document which has been made public for the purpose mentioned in paragraph 12(1)(a) of Schedule 4 to the Act, subject to the payment of a reasonable charge therefor.

Prescribed period for making representations

5. The prescribed period for the purposes of paragraph 12(1) of Schedule 4 to the Act shall be such period (not being less than six weeks) as shall be specified by an authority when giving publicity thereunder to the matters proposed to be included in a local plan.

PART III

CONSULTATION

Consultation

6. Before finally determining the content of a local plan, the local planning authority shall consult, with respect to the matters they propose to include in the plan, such authorities or bodies as the local planning authority think appropriate or the Secretary of State may direct, and the local planning authority shall afford to any authority or body consulted a reasonable opportunity to express their views and shall take their views into consideration.

PART IV

FORM AND CONTENT OF LOCAL PLANS

Title

7. A local plan shall be given a title which shall include the name or names of the local planning authority or authorities who prepared the plan, an indication of the area to which the plan relates and the name given to the particular plan by or under regulation 8; and each document contained in or accompanying a local plan shall bear the title of the plan.

District action area, GLC action area and subject plans

8.—(1) A local plan based on a comprehensive consideration of matters affecting the development and other use of land in the area to which it relates shall, unless it is a local plan for an action area or GLC action area, be called a "district plan".

(2) A local plan for an action area shall be called an "action area plan."

(3) A local plan for a GLC action area shall be called a "GLC action area plan".

(4) A local plan which is based on a consideration of a particular description or descriptions of development or other use of land in the area to which it relates shall be called by the name of the subject or subjects to which it relates.

Proposals

9.—(1) The proposals formulated in a local plan written statement shall relate to such of the matters specified in Part I of Schedule 1 as the local planning authority preparing the plan may think appropriate.

(2) The proposals formulated in a local plan written statement shall be set out so as to be readily distinguishable from the other contents thereof.

(3) A local plan written statement shall contain a reasoned justification of the proposals formulated therein.

Matters to be contained in written statement

10. In addition to the other matters required to be contained therein by the Act and by these regulations, a local plan written statement shall contain the following matters, namely, such indications as the local planning authority preparing the plan may think appropriate of the items set out in Part II of Schedule 1.

Maps, insets and diagrams

11.—(1) The map comprised in a local plan in compliance with paragraph 11(2) of Schedule 4 to the Act shall be called the proposals map, and shall—

(a) be prepared on a map base reproduced from, or based on, the Ordnance Survey map, and showing National Grid Lines and numbers;

(b) subject as hereinafter mentioned, be prepared to such scale as the local planning authority preparing the plan may think appropriate, or the Secretary of State may direct:

Provided that the proposals for any part of the area to which a local plan relates may be shown to a larger scale on an inset prepared in accordance with sub-paragraph (a) above; and the proposals shown on an inset may be shown on the proposals map by showing thereon the boundary of the inset.
