THE TRADING WITH THE ENEMY (AUTHORISATION) ORDER, 1943, DATED JULY 15, 1943, MADE BY THE BOARD OF TRADE UNDER SECTIONS 1 AND 7 OF THE TRADING WITH THE ENEMY ACT, 1939 (2 & 3 GEO. 6. C. 89).2 & 3 Geo. 6. c. 89.
The Board of Trade in exercise of the powers conferred upon them by Sections 1 and 7 of the Trading with the Enemy Act, 1939, and of all other powers enabling them in that behalf do hereby make the following Order:—
1. Notwithstanding anything contained in Section 1 of the Trading with the Enemy Act, 1939, any person, unless the Board of Trade otherwise direct, may trade within the territories specified in the Schedule hereto with any individual or body of persons (whether corporate or unincorporate) carrying on business therein.
2. Articles 4 and 5 of the Trading with the Enemy (Custodian) Order, 1939(a) (which impose restrictions and requirements in regard to the property in the United Kingdom of enemies), shall not apply to any property belonging to or held or managed for or on behalf of any such individual or body of persons as is mentioned in Article 1 of this Order: Provided that where such individual or body of persons carries on business in any of the territories specified in the Schedule hereto and also in enemy territory, this Article shall only extend to so much of the property as is held or used solely for the purposes, of the business so far as it is carried on in any of the territories so specified.
3. The Trading with the Enemy (Madagascar) Order, 1942(b), and the Trading with the Enemy (French Somaliland, Reunion and Dependencies of Madagascar) Order, 1943(c), are hereby revoked.
