TRADING WITH THE ENEMY

THE TRADING WITH THE ENEMY (AUTHORISATION) (FRENCH INDO-CHINA) ORDER, 1946, MADE BY THE BOARD OF TRADE.

2 & 3 Geo. 6. c. 89.

The Board of Trade in exercise of the powers conferred upon them by Sections 1 and 5 of the Trading with the Enemy Act, 1939 (hereinafter referred to as "the Act"), and of all other powers enabling them in that behalf do hereby make the following Order:—

1. Notwithstanding anything contained in Section 1 of the Act any person unless the Board of Trade otherwise direct may trade within French Indo-China with any individual or body of persons (whether corporate or unincorporate) carrying on business therein.

2. The transfer by or on behalf of any person within the description contained in Article 3 of this Order of any annuities, stocks, shares, bonds, debentures or debenture stock registered or inscribed in any register, branch register or other book kept in the United Kingdom which on or after the date of this Order come into the ownership of any such person as aforesaid, is hereby sanctioned.

3. Article 2 of this Order shall apply—

(a) to any individual resident in French Indo-China,

(b) as respects any business carried on in French Indo-China to any individual or body of persons (whether corporate or unincorporate) carrying on that business,

(c) as respects any business carried on in any territory which is not an area which is for the time being to be treated as enemy territory for the purposes of Section 5 of the Act in accordance with the provisions of Regulation 6 or Regulation 7 of the Defence (Trading with the Enemy) Regulations, 1940(a), to any body of persons (whether corporate or unincorporate) carrying on that business if and so long as the body is controlled by any individual resident in or body of persons carrying on business in French Indo-China.

4. This Order may be cited as the Trading with the Enemy (Authorisation) (French Indo-China) Order, 1946.
