Background
1. Transcold Refrigeration Limited (“the applicant”) occupies premises at 7(c) Springhill Road,
Carnbane Industrial Estate, Newry and Cooltech Refrigeration (NI) Limited occupies the
adjoining, intercommunicating premises at 7(b) (“the reference property”).
2. The managing director of the applicant company is Mr Paul Fegan and the managing director
of the respondent company is his brother, Mr Konrad Fegan.
3. For many years, due to a close family relationship, the companies worked together on a trust
