The Tribunals and Inquiries (Social Security Commissioners) Order 1980

The Lord Chancellor and the Lord Advocate, in exercise of the powers conferred on them by section 12(6) of the Tribunals and Inquiries Act 1971(a), and after consultation with the Council on Tribunals, hereby make the following Order:—

1.—(1) This Order may be cited as the Tribunals and Inquiries (Social Security Commissioners) Order 1980 and shall come into operation on 24th November 1980.

(2) In this Order "Commissioner" has the same meaning as in the Social Security Act 1975(b).

2. Section 12(1) of the Tribunals and Inquiries Act 1971 shall not apply to:—

(a) a Commissioner's decision on an application for leave to appeal under section 14 of the Social Security Act 1980(c) (applications for leave to appeal from a decision of Commissioner);

(b) a Commissioner's decision on an application for leave to appeal under section 15(1) of the Social Security Act 1980 (applications for leave to appeal from a unanimous decision of a local tribunal);

(c) a Commissioner's decision on an application for leave to appeal pursuant to section 15A(2)(a)(ii) of the Supplementary Benefits Act 1976(d) (applications for leave to appeal from a decision of an Appeal Tribunal);

(d) a Commissioner's decision on an application for leave to appeal under section 112(3) of the Social Security Act 1975 (applications for leave to appeal from a decision of a medical appeal tribunal); and

(a) 1971 c. 62, as amended by the Transfer of Functions (Secretary of State and Lord Advocate) Order 1972 (S.I. 1972/2002).

(b) 1975 c. 14, as amended by section 12 of the Social Security Act 1980 (c. 30).

(c) 1980 c. 30.

(d) 1976 c. 71; section 15A was inserted by section 6(1) of the Social Security Act 1979 (c. 18).

(e) a Commissioner's decision on an application for leave to appeal pursuant to section 106(2) of the Social Security Act 1975 (applications for leave to appeal against a determination by the Attendance Allowance Board).
