The Trinidad and Tobago (Constitution) Order in Council, 1958

The Queen's Most Excellent Majesty in Council

Her Majesty, by virtue and in exercise of the powers vested in Her by the Trinidad and Tobago Act, 1887(a), and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

Citation and construction

1.—(1) This Order may be cited as the Trinidad and Tobago (Constitution) Order in Council, 1958, and shall be construed as one with the Trinidad and Tobago (Constitution) Order in Council, 1950(b), (in this Order referred to as "the principal Order").

(2) This Order, the principal Order and the Trinidad and Tobago (Constitution) (Amendment) Order in Council, 1956(c), may be cited together as the Trinidad and Tobago (Constitution) Orders in Council, 1950 to 1958.

(3) Any reference in this Order to a law of the Colony shall be deemed to be a reference to that law as from time to time amended.

(4) This Order shall be published in the Gazette.

Certain offices deemed not to be offices of emolument

2. In relation to the period beginning on the appointed day and ending on the 5th day of November, 1957, the principal Order shall have effect and shall be deemed always to have had effect as if none of the offices set out in the Second Column of the Schedule to this Order (being offices constituted under the laws of the Colony respectively set out in the First Column to that Schedule) was an office of emolument under the Crown for any of the purposes of the principal Order.

Travelling or subsistence allowance not to constitute office of emolument under the Crown

3.—(1) For the purposes of the principal Order a person shall not be deemed to hold an office of emolument under the Crown by reason of holding an office under the Crown in respect of which he receives or is entitled to receive payment by way only of travelling and of subsistence allowances or travelling or subsistence allowances or a refund of out of pocket expenses.

(2) Subsection (1) of this section shall be deemed to have had effect as from the appointed day.
