Statement as to interest charged - Inaccuracy in - Signature of "borrower" - Sureties.

The plaintiffs made a loan upon a promissory note, the statutory memorandum in which grossly misstated the rate of interest to be charged. Held, that the memorandum was insufficient and, accordingly, that the promissory note was unenforceable by the lender, Semble, that the sureties as well as the person to whom the money is actually paid should sign the memorandum as "borrowers."
