TERMS AND CONDITIONS OF EMPLOYMENT

The Unfair Dismissal (Variation of Qualifying Period) Order 1979

Whereas a draft of the following Order was laid before Parliament in accordance with section 149(4) of the Employment Protection (Consolidation) Act 1978(a) ("the 1978 Act") and approved by resolution of each House of Parliament:

Now, therefore, the Secretary of State, in exercise of the power conferred on him by section 149(1)(c) of the 1978 Act and all other powers enabling him in that behalf hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Unfair Dismissal (Variation of Qualifying Period) Order 1979 and shall come into operation on 1st October 1979.

Variation of qualifying period

2. Subject to Article 3, section 64(1)(a) of the 1978 Act is varied so that for the reference to "twenty-six weeks" there is substituted a reference to "fifty-two weeks".

Transitional and supplementary provisions

3.—(1) The variation specified in Article 2 shall have effect where the effective date of termination as defined in section 55(4) or, where applicable, section 55(5) of the 1978 Act falls after this Order comes into operation.

(2) In section 64(2) of the 1978 Act, for the reference to the words "twenty-six weeks" appearing in section 64(1)(a) there is substituted a reference to the words "fifty-two weeks".

EXPLANATORY NOTE

(This Note is not part of the Order.)

This Order, which comes into operation on 1st October 1979, varies the qualifying period of twenty-six weeks for unfair dismissal complaints to an industrial tribunal to fifty-two weeks where the effective date of termination falls on or after 1st October 1979.
