The Upper Spey and Associated Waters Protection (Renewal) Order 1988

Made 2nd March 1988

Coming into force 15th March 1988

The Secretary of State, in exercise of the powers conferred on him by section 1(7) of the Freshwater and Salmon Fisheries (Scotland) Act 1976(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

S-1 Citation and commencement

1. This Order may be cited as the Upper Spey and Associated Waters Protection (Renewal) Order 1988 and shall come into force on 15th March 1988.

S-2 Interpretation

Interpretation

2. In this Order—

“the 1982 Order” means the Upper Spey and Associated Waters Protection Order 1982(2); and

“the 1985 Order” means the Upper Spey and Associated Waters Protection (Renewal) Order 1985(3).

S-3 Renewal of Order

3. The 1985 Order is hereby renewed.

S-4 Prohibition

4. During the period from 15th March 1988 to 6th October 1990, both dates inclusive, fishing for or taking freshwater fish in the inland waters in the area prescribed in article 4 of the 1982 Order, without legal right or without written permission from a person having such a right, is hereby prohibited.

This Order has the effect of renewing for a second time the Upper Spey and Associated Waters Protection Order 1982 which prohibited fishing for or taking freshwater fish in inland waters in the area prescribed in that Order without legal right or without written permission from someone having such a right. The effect of the renewal is that the prohibition has effect from 15th March 1988 to 6th October 1990.

The prescribed area referred to is those parts of the catchment areas of the Rivers Spey, Spean and Tummel lying within Highland and Tayside Regions. The area is illustrated on a map attached to the 1982 Order and is defined by reference to a large scale map which may be inspected at Chesser House, Gorgie Road, Edinburgh on any working day between 8.30am and 4.30pm.
