against women constitutes a violation
of
human rights, stressing that the States may be
liable for private acts
if
they fail to act with due diligence to prevent violations
of
rights, or to investigate and punish aets of violence, or fail to provide measures
of
reparation or compensation (E/CN.4/1996/53, 5February 1996, Commission on Human
Rights, p. 10, para. 34). In keeping with the criterion set out by the CEDAW, the
Commission recommends that the States revise and amend domestic legislation,
punishing conduct that has not yet been defined as a crime such as sexual harassment,
amending procedures in the investigation stage that are discriminatory and/or prejudicial
because the victim is a woman engaging in 'immoral conduct', and to investigate and
punish cases
of
domestic violence with due diligence through prompt and simple
judicial remedies.

The
African Commission on
Human
and
Peoples' Rights
The African Commission on Human and Peoples' Rights has recently held its 24th
Ordinary Session.' Following the death of Commissioner Beye, the African Commission
devoted an afternoon
of
this session to tributes and decided to create a human rights award
in his name. No new member
of
the Commission has yet been elected.
A. International
Criminal
Court
The African Commission adopted one resolution in the course of its 22nd and 23rd
sessions, on the International Criminal Court where it recommended that the Council
of
Ministers and Assembly
of
Heads of State and Government
of
the OAD co-ordinate efforts
during the Rome conference to support the establishment
of
the Court. The Chairman
of
the African Commission was called upon to represent it there and to report back to the
Commission.' Six resolutions were taken at its 24th session, including one on the conflict
in Guinea-Bissau, although none
of
these are detailed in its Final Communique.'
B. Fiftieth Anniversary of
the
UDHR
Preparations for the 50th Anniversary
of
the Universal Declaration
of
Human Rights
continued to be discussed by the Commission, although no concrete projects appear to have
been compiled. At its 24th session the Commission did note that it would issue a statement
to be distributed among all States party to the Charter in commemoration
of
the event.
