[17] walden versus vessey. H. 1 cab. rot. 710. En debt sur le statute de 29 Eliz. cap. 4. le parols de quel statute ensue, upon extents, and executions the sheriff shall take 12d. of, and for every 20s. where the same exceeds not 1001. and 6d. of, and for every 20s. being over, and above the said sum of 1001. provided, that this Act shall not extend to any fees to be taken for any execution to be had within any city, or town corporate. Rot. 531. sur execution de 4001. 121. fuit demand, viz. 51. pro primer 1001. & forsque 6d. apres. Et judgement fuit pro querente. 2. Le second point en le case fuit tiel, le proviso dit, que ceux fees ne serront prise pur ascun executions had in any town corporate. Et le vie. del county en nostre case enter un corporation, & execute 1'execution, le question ore fuit, ou il avera le fee; & serra hors de proviso. Et Whitwick argue, que avera cest fee, nient obstant le proviso. Et premierment, quia nul home voet denyer, si il ad prise le prisoner juxta mure del town, donque il avera le fee, & quare nori come bien, prisont luy diens le town : car est cleere, que les parols del proviso sont d'estre entend del executions fait sur judgments done en le corporation, la nest reason, que le bayliff, or vie. avera cy large fees pur un prisoner, quel inhabit forsan al prochen meason a luy, come le vie. avera quel forsan travels longe pur luy. Et, sans doubt, si un forrein vie. naveroit fees pur executions faits en corporations, deux grand inconveniences ensueront; premierment le vie. ayanfc nul fee voet estre tarde & slow a faire executions, si le party soit en uu corporation, & issint justice & 1'execution del justice, quel est mult favourd en le ley, serroit delay.
