LATCH. 69. WARNER V. HARDING 279 [69] warner versus harding, devant. Hedley Serjeant; que c condition est done al Royne, & est bieu performe p q^ le Royne ad gain le fee-simple, issint q^ le lease fait p luy est bone. Les reasons al contrary sont, c^ per Act del Parliament il forfeit tout son terre, &o. Et touts conditions ne sont done al Royne; & ils mit le case de Templers 17 E. 2. pensions done al Hospitalers a teuer al eux en mesme manner come les Templers, &c. Uncore frank-almoigne nest transfers per ceux general parols. Issint per general parols de touts hereditaments, &c. un droit d'action nest done, come en Le Marquess de Winchesters case. Ceux cases il agree, & est un grand difference en nostre case, lou general parols sont, queux conteyne diversa genera, voua naves tout de south tiels general parols, mes 1'statute avera reasonable sense, & serra expound come les patents del Roy serront. Et pur c si le Roy grant per ses letters patents, de south le Grand Seale touts mines, uncore le patentee navera Royal mines. Issint, quand touts possessions sont done, la est un droit d'entry, & droit d'action, mes le droit d'action nest done p les general parols d'un Act de Parliament. Ore le parol condition est species, et a'est ascun genus, & le statute de 26 H. 8. que tiel, forfeitera touts terra tenements, & hereditaments, q^ ascun tiel offender avoit dascun estate d'inheritance vous ne dis-tinguisher le quel estate d'inheritance soit en fee ou en tayle; entant, q^ sont forsq^ ceux deux estates d'inheritance, & le statute dit, q^ forfeitera tout sou terre, q^ ad de aacun estate d'inheritance; et un condition, est cy single come inheritance. La sont conditions, que sont incident al reversion, & conditions en grosse, & sont conditions d'estre performe del parte del feoffer, & del parte del feoffee, queux sont accidental. Feoffment sur condition, que si le Chief Justice fait tiel chose, que donq^ il entra, & apres le feoffbr est attaint del treason, c condition est done a Roy, & uncore il ne poet performer c; mes si le Chief Justice performe le condition, le terre est done a Roy. Feoffment sur condition, que si le feoffer aler al Rome il reentra, & apres le feott'or est attaint del treaaon, & apres aler al Rome, & performe le condition, le Roy avera le terre, uncore le Roy n'ad power de performer le condition.
