WEIGHTS AND MEASURES

Whereas the Secretary of State pursuant to section 15(3) of the Weights and Measures Act 1979(a) has consulted such organisations as he considers are representative of interests which would be substantially affected by these Regulations:
Now, therefore, the Secretary of State, in exercise of the powers conferred on him by sections 1, 13, 14(1) and 15 of that Act, and of all other powers enabling him in that behalf, hereby makes the following Regulations:—
1. These Regulations may be cited as the Weights and Measures (Packaged Goods) (Amendment) Regulations 1985 and shall come into operation as follows:—
(a) Regulations 1 and 2 on 10th May 1985; and
(b) Regulation 3 on 1st January 1986.
2. The Weights and Measures (Packaged Goods) Regulations 1979(b) shall be amended as follows:—
(a) in Part I of Schedule 1, in item 2 in column 3, for the words "10 kg" there shall be substituted the words—
"(i) in the case of fish, 10 kg;
(ii) in the case of poultry, 20 kg"; and
(a) 1979 c.45.
(b) S.I. 1979/1613, as amended by S.I. 1980/1064, 1982/144, and with effect from 1st January 1986 by 1984/1317.
(b) in paragraph 1 of Part I of Schedule 3—
(i) after sub-paragraph (b), in column 1, there shall be inserted the following:—
";or
(c) poultry but not including part only of any poultry";
(ii) in paragraphs 1(A)(c) and 1(B)(c), in column 2, before the words "column 1" there shall be inserted the words "sub-paragraphs (a) and (b) of"; and
(iii) in paragraph 1(B), in column 2, after sub-paragraph (c) there shall be inserted the following:—
"and
(d) in the case mentioned in sub-paragraph (c) in column 1 —
(i) in Regulation 2(3) the words "before the goods are placed in the packages" were omitted,
(ii) at the end of Regulation 10(7) there were added the words "Provided that in the case of packages other than packages marked with the EEC mark, for the provisions referred to in this paragraph there shall be substituted the following provisions:—
Regulation 8(1) and (2)(b),
Regulation 9(3),
Regulation 10(1), (4), (6) and (8),
Regulation 11(3) with the substitution for the words "metric units" onwards of the words "imperial or metric units or in both imperial and metric units",
Regulation 12(1) and (2),
Regulation 14(1) and
Regulation 15;
and
(iii) in Regulation 22(2)...
