CHAPTER xliii.
An Act to confer further powers on the county council of
the administrative county of West Sussex with respect
to the acquisition and user of lands the stopping up
and diversion of highways and the sale of coke and
for other purposes. [26th July 1946.]

HEREAS it is expedient that further powers should be
conferred on the county council of the administra-
tive county of West Sussex with reference to the acquisition
and user of lands the stopping up and diversion of highways
and the sale of coke:
And whereas the said county council are members of the
County Councils Association and it is expedient to empower
them by agreement with that association approved by the
Minister of Health to admit the employees of the association
to participate in the benefits of the superannuation fund of
the said county council:
And whereas it is expedient to increase the amount of money
which the Littlehampton Harbour Board may retain as a
working balance:
And whereas it is expedient that the other provisions of
this Act be enacted:
And whereas the objects 0! this Act cannot be attained
without the authority of Parliament:
And whereas in relation to the promotion of the Bill for
this Act the requirements of Part XIII of the Local Govern- 23

and with the advice and consent of the Lords Spiritual and
Temporal and Commons in this present Parliament assembled
and by the authority of the same as follows:

PART I.
PRELIMINARY.
1.
This Act may be cited as the West Sussex County Council
Act 1946.
2.
This Act is divided into Parts as follows:
Part I.—Preliminary.
Part II.—Sale of coke &c.
Part III.—Miscellaneous.
3.
The Lands Clauses Acts so far as applicable for the
purposes and not inconsistent with the provisions of this Act
are hereby incorporated with this Act with the following ex-
ceptions and modification:
(a) Sections 127 to 132 of the Lands Clauses Consolida-
tion Act 1845 and the provisions of that Act with
respect to the purchase and taking of lands other-
wise than by agreement are not incorporated with
this Act;
(b) The bond required by section 85 of the Lands
Clauses Consolidation Act 1845 shall be under the
common seal of the County Council and shall be
sufficient without the addition of the sureties men-
tioned in that section.

In this Act unless the context otherwise requires
Words and expressions to which meanings are assigned
by the Lands Clauses Acts have the same respec-
tive meanings except where otherwise enacted;
'' the county '' means the administrative county of West
Sussex;
" the County Council M means the County Council of the
county;

SALE OF COKE &C.
Application to 5. The provisions of sections 20 to 29 of the Weights and
Weyhts°and0f
MeasuFes
Act l889 and of any byelaws made by the County
Council thereunder (which provisions and byelaws relate to
the sale of coal) shall also apply (except as hereinafter other-
