The Western Pacific (Courts) (Amendment) Order 1966

The Queen's Most Excellent Majesty in Council

Her Majesty, by virtue and in exercise of the powers in that behalf by the British Settlements Acts 1887 and 1945(a), the Pacific Islanders Protection Acts 1872 and 1875(b), the Colonial Courts of Admiralty Act 1890(c), the Foreign Jurisdiction Act 1890(d) or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

Citation, construction and commencement.

1.—(1) This Order may be cited as the Western Pacific (Courts) (Amendment) Order 1966 and shall be construed as one with the Western Pacific (Courts) Order in Council 1961(e) (hereinafter called "the principal Order").

(2) This Order and the principal Order may be cited together as the Western Pacific (Courts) Orders 1961 and 1966.

(3) This Order shall come into operation on a date to be appointed by the High Commissioner by Proclamation, which date shall not be earlier than 27th September 1966.

Amendment of section 19 of principal Order.

2. Section 19(1) of the principal Order is amended by the substitution of the words "the Court of Appeal established for Fiji by the Fiji Constitution (hereinafter in this section called the Fiji Court of Appeal)" for the words "the Fiji Court of Appeal constituted under the Court of Appeal Ordinance of the Colony of Fiji".

Transitional provisions.

3.—(1) Any proceeding arising from the High Court of the Western Pacific and pending before the Fiji Court of Appeal constituted under the Court of Appeal Ordinance of the Colony of Fiji on the date this Order comes into operation may be carried on before the Court of Appeal established by the Fiji Constitution as if it had been commenced therein.

(2) Any judgment of the Fiji Court of Appeal constituted under the Court of Appeal Ordinance of the Colony of Fiji given in any proceeding arising from the High Court of the Western Pacific but not satisfied before the date this...
