The Secretary of State, in exercise of the power conferred by section 1 of the Wireless Telegraphy Act 19491(“The Act”) as enacted, and as extended by the Wireless Telegraphy (Channel Islands) Order 19522and the Wireless Telegraphy (Isle of Man) Order 19523, and now vested in him4, and of all other powers enabling him in that behalf, hereby makes the following Regulations:
Citation and Commencement
1. These Regulations may be cited as the Wireless Telegraphy (Cordless Telephone Apparatus) (Exemption) Regulations 1988 and shall come into force on 24th October 1988.
Interpretation
2. In these Regulations, “relevant cordless telephone apparatus” means wireless telegraphy apparatus consisting of —
(a) a base station; or
(b) a cordless handportable set,
which is designed or adapted to convey messages, in digitised packets in time division duplex mode bi — directionally in a single channel of 100kHz bandwidth within the band 864.1 to 868.1 MHzMHz between a telecommunication system to which such a base station is connected and such a cordless handportable set; and for the purpose of this definition, “connected”, “convey” and “telecommunication system” shall be construed in accordance with section 4 of the Telecommunications Act 19845.
Exemption
3. Subject to the terms, provisions and limitations contained in regulation 4, relevant cordless telephone apparatus is hereby exempted from the provisions of section 1(1) of the Act.
Terms, provisions and limitations
4. The exemption provided for in regulation 3 shall be subject to the following terms, provisions and limitations —
(a) the apparatus must comply with Department of Trade and Industry Performance Specification MPT 1334 as published in December 1987; and
(b) the apparatus must not cause undue interference with any wireless telegraphy.
