THE WORKMEN'S COMPENSATION (AIRCRAFT) ORDER, 1924, DATED DECEMBER 19, 1924, MADE BY THE SECRETARY OF STATE, EXTENDING THE PROVISIONS OF THE WORKMEN'S COMPENSATION ACTS TO EMPLOYMENT ON AIRCRAFT WHEN OUTSIDE GREAT BRITAIN.

In pursuance of the powers conferred on me by Section 27 of the Workmen's Compensation Act, 1923, I hereby make the following Order:—

1. For the purposes of this Order the term "aircraft" means any balloon, airship or flying machine registered in Great Britain and Northern Ireland, the owner of which resides or has his principal place of business in Great Britain.

2. The Workmen's Compensation Act, 1906, as amended by the Workmen's Compensation Act, 1923, shall apply to such persons employed as pilot, commander, navigator or member of the crew of any aircraft when outside Great Britain, as are workmen within the meaning of the said Acts, subject to the following modifications and exceptions:—

(a) Where the accident causing the injury did not occur during or in connection with the flight, taking off or landing of the aircraft, compensation shall not be payable.

(b) In the case of a fatal accident, the claim for compensation shall be made within six months after news of the death has been received by the claimant.

(c) Where an injured pilot, commander, navigator or member of the crew of any aircraft is discharged or left behind in a British possession or foreign country, depositions respecting the circumstances and nature of the injury may be taken and made available as evidence in the manner provided by subsection (1) (c) of Section 7 of the Workmen's Compensation Act, 1906, in the case of seamen, and that subsection shall apply accordingly.
