[435] O'CoNNER 11. sierra nevada company. Nov. 18, 1857. A Plaintiff having gone abroad on matters connected with the suit, was ordered to give security for costs, but having returned to this country the order was discharged. The bill was filed on the 6th of November 1856, relating to a mine in California. On the 31st of January 1857 the Plaintiff went to California on matters connected with the suit, and on the 25th of February following he was ordered to give security for costs. Two months afterwards (23d April 1857), the Defendant moved that the security might be given within a limited time, or, in default, that the bill might be discharged with costs. The Master of the Rolls considered the motion premature, and ordered it to stand over. (23 Beav. 608.) On the 27th of October the Defendant gave notice that he would renew the motion, but the Plaintiff returned to this country on the 14th of November, before the motion had been brought on.
