The Customs Duties (ECSC) (No. 2) (Amendment No. 5) Order 1986

The Treasury by virtue of the powers conferred on them by section 5(1) and (3) of, and paragraph 4 of Schedule 2 to, the European Communities Act 1972(a) and of all other powers enabling them in that behalf, on the recommendation of the Secretary of State, hereby make the following Order:—

1.—(1) This Order may be cited as the Customs Duties (ECSC) (No. 2) (Amendment No. 5) Order 1986 and shall come into operation on 1st January 1987.

2. The Customs Duties (ECSC) (No. 2) Order 1985(b) shall be amended as follows:—

(a) in Article 2, the reference to the CCT Schedule shall be a reference to the CCT Schedule annexed to Council Regulation (EEC) No. 950/68(c) as last amended by Council Regulation (EEC) No. 3618/86(d); and

(b) in Article 4—

(i) for paragraph (1A) there shall be substituted the following paragraph:—

"(1A) Paragraph (1) above shall not apply in relation to any goods on which any customs duty is charged by the Customs Duties (Spain) (Transitional Measures) Order 1986"(e); and

(ii) paragraphs (3) and (4) shall be deleted.

EXPLANATORY NOTE

This Order amends the Customs Duties (ECSC) (No. 2) Order 1985 (the principal Order). It updates the reference to the CCT Schedule, by reference to which rates of customs duty are charged under the unified ECSC tariff on certain ECSC products imported into the United Kingdom.
